By using the Services, you are agreeing to all of the Terms and Conditions of Use, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms and Conditions of Use. ?Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. Meathead has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. This Website has been developed for use by customers and intended customers. You agree not to use the Website in any way that causes or is intended to cause access or the website to be damaged, interrupted, or impaired in any way. You agree that you will not:

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

The intellectual property rights in all software and content made available to you on or through this Website remains the property of Meathead or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Meathead and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise. ? You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Meathead or its licensors. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are colourably similar without the written permission of Meathead.

Contract

When you place an order to purchase a product from Meathead, we will send you an email confirming receipt and details of your order. Our acceptance of this offer to purchase will be at the time we dispatch that product to you and a confirming email in this regard is sent. The acceptance will be complete at this time. It is agreed at the time you place an order it is your intention to enter into a contract with Meathead.

Pricing and availability

All pricing is in Australian dollars. Meathead list products for sale on its Website as indicated. Whilst we use our best endeavors to fulfill such orders, we cannot be held responsible if the products are not available at a given point in time. It is further noted that dispatch times indicated below and in our Shipping and Returns information are a guide and are not guaranteed dispatch times and should not be relied upon as such.

Customs

When ordering goods from meathead.com.au for delivery to any destination outside Australia, the recipient may be charged import duty and other taxes including but not limited to sales tax which are levied on import values above a threshold by the customs authority in that overseas country. It is the responsibility of the purchaser to pay these amounts to the freight company if applicable prior to delivery. It is outside Meatheads area of control and responsibility to determine, advise or influence these charges. As customs policies vary drastically from country to country, you are requested to direct queries of this nature to your local customs office. Customers should also note that the recipient is to be regarded as the Importer of record and you will need to comply with whatever regulations are required in this regard in the country of the recipient. Meathead are neither able to advise on process to claim back, nor refund, any duty and taxes paid should an ordered item be returned.

Consent

Meathead assumes all sales are made to persons over the age of 18 and possess a valid credit or debit card issued by a bank acceptable to us. If you are under 18, you must have the involvement of a parent or guardian Meathead retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Meathead or may in some cases be a third party. Where a contract is made with a third party Meathead is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Payment

Payment is only accepted by means of the credit card types as shown and Paypal. We are unable to process any other payment form and apologise for any inconvenience this may cause. Waiver

Should you breach any terms or conditions, and we take no action against you, we shall be entitled to invoke our rights and remedies in any other situation where you breach these conditions.

Governing Law

The above terms and conditions are governed by the laws applicable of the state of Western Australia and all applicable laws of the Commonwealth of Australia. Both parties submit to the non exclusive jurisdiction of the Courts in Western Australia.

Shipping

Delivery is available to Australia only. We will ship your order as soon as possible, usually the next business day after your order is processed, and will usually arrive within 3-10 business days, subject to payment authorisation and stock availability. Important information

We are unable to redirect orders once items have been dispatched. Order cut-off times are provided as guidelines only, and do not take into account possible delays caused by payment authorisation. We cannot beheld liable for any delay in delivery and the above time is as provided to us by Australia Post and any applicable freight company.

Returns

If you are not completely happy with an item, we will exchange it or give you a refund, provided that its returned to us in its original condition and packaging, unworn, unwashed, and with all labels intact. Please include a copy of your original invoice as we will require this to process the refund. Requested exchange items are subject to availability. Please make sure that underwear purchased from our Website is tried on over your own underwear. In the interests of hygiene, we may refuse returns of items where it is obvious that this has not been done. Returns and exchanges are accepted on merchandise within 30 days of receipt. PLEASE NOTE: Shipping and handling charges are non-refundable. If you return a product on which duty and tax has been paid, Meathead are unable to refund such duty or taxes. Although Meathead provide free shipping for all purchases, we will not take responsibility for shipping and postage costs associated with the return of your item.

Refunds

Once your package has been received, your refund will be processed in the original form of payment within 7 business days. You will be notified via email to the address listed on your account when this transaction has taken place. Please note that your banking institution may require additional days to process and post this transaction to your account once they have received the information from Meathead.

Replacements/Exchanges

Postage for any additional exchanges will be charged as per standard Australia Post rates. Original payment via Paypal: if you have requested replacements of a higher or lower value, we will process a full refund and you will need to place a new order for the replacement item. Payment adjustments cannot be made via Paypal. If you have requested a replacement of the exact same value, we will process the exchange and mail you the replacement, subject to stock availability. All replacement items are sent using Australia Post and standard Australia Post charges will be applied (except in the event where the item is faulty). Cardholder account data

Meathead does not store any cardholder data, all credit card payment service are handled by through PayPal. For more information regarding the PayPal service please read PayPals User Agreement, Product Disclosure Statement, and Privacy Policy.

Disclaimer of Liability 

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Meathead and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Meatheads liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

Linking to this Website 

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

Meathead shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website. 

Invalidity 

If any part of the Terms and Conditions of Use is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms and Conditions of Use will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause/sub-clause as is permitted by law.

The above Terms and Conditions of Use constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Meathead.
